OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from crush by and/or struck by hazards: (a) Facility, 600 Grant Street, West Elizabeth, PA: On or before January 26, 2018 employees overloaded the lift gate when having to deliver pallets of salt. The lift gate is rated for 2000 lbs. and a pallet of salt weighs approximately 2450 lbs. The lift gate was being overloaded by 450 lbs. and exposed employees to potential struck by and/or crushing hazards should the lift gate fail.

29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling: (a) Facility, 600 Grant Street, West Elizabeth, PA: On or about January 25, 2018 the employer did not ensure that employees were protected from falling approximately 11 1/2 feet when they accessed the upper level of the storage systems. Employees use a materials picker to access the upper storage level and walk onto the level to gather product and no fall protection systems are in place to prevent the employee from falling approximately 11 1/2 feet to the floor below.

Employees use step ladders and stair ladders and the employer has not provided any training on the proper inspection, use, care or storage of the equipment.
