29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    On Jan. 29, 2018, located on the south side of a commercial structure, there were no frequent and regular inspections being performed by a competent person to ensure the jobsite, materials and equipment such as tubular welded frame scaffolds & fall protection systems and/or devices were being maintained and utilized in a safe condition.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.    On Jan. 29, 2018, located on the south side of a commercial structure, employees were observed working from a tubular welded frame scaffold that were not trained in their language of origin (Spanish) and/or presented information in a manner that employees could understand how to minimize those hazards. Potential fall heights were measured to be greater than 13 feet above the ground below while not utilizing a fall protection system.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    The employer did not provide a training program for employees that were observed performing grouting work from a tubular welded frame scaffold while not utilizing a fall protection system and exposed to fall heights greater than 13 feet above the ground below.

29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) shall be installed so that the space between adjacent units and the space between the platform and the uprights is no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary (for example, to fit around uprights when side brackets are used to extend the width of the platform).    On Jan. 29, 2018, located on the south side of a commercial structure, an employee was observed working from an  upper level tubular welded frame scaffold platform that was not fully planked. Potential fall heights were determined to be greater than 13 feet above the ground below.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.    Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.    On Jan. 29, 2018, located on the south side of a commercial structure, an employee was observed working from an upper level platform of a tubular welded frame scaffold while not utilizing a fall protection system. Potential fall heights were measured to be greater than 13 feet above the ground below.
