29 CFR 1910.22(a)(1): The employer failed to provide a clean and sanitary condition for all places of employment, passageways, storerooms, service rooms, and walking-working surfaces. Employees performing maintenance tasks were exposed to fire and explosion hazards in that the employer did not implement their housekeeping program and dust was allowed to accumulate in the following locations: A) The leg above conveyor in the tunnel near Bin #43. Dust measured 1 and 5/8 inches deep. B) The leg above conveyor in the tunnel near Bins #35 and #36. Dust measured 3/8 of an inch deep. C) The leg above conveyor in the tunnel near Bin #27. Dust measured 7/16 of an inch deep. D) The leg above conveyor in the tunnel near Bins #31 and #32. Dust measured 1 and 7/8 inches deep. E) The floor beneath the conveyor in the tunnel near Bin #16. Dust measured 2 and 1/2 inches deep.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: Employer did not provide a written respiratory program to control and address the use of a MSA full face respirator with a Phosphine/Ammonia/Chlorine/P100 cartridge. Employees were exposed to inhalation hazards from phosphine gas while using the controlled restricted pesticide Killz-All 60 as a fumigant.

29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or were not packed or stored to prevent deformation of the facepiece and exhalation valve: Employer did not provide proper storage for a MSA full face respirator with a Phosphine/Ammonia/Chlorine/P100 cartridge. The respirator was stored in the same cabinet on the same shelf as the Killz-All 60 without benefit of an enclosed container to protect it from excessive moisture and leaching from the proximal pesticide. Employees were exposed to inhalation hazards from phosphine gas while using the mask while applying the controlled restricted pesticide Killz-All 60 as a fumigant.
