29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):       29 CFR 1926.602(d): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.       a) On or about January 31, 2018, the employer engaged in the operation of an all-terrain forklift without ensuring competency to operate the equipment safely, as demonstrated by successful completion of forklift training and evaluation.           In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection when machines or operations present potential eye or face injury from physical, chemical, or radiation agents:                a) On or about January 31, 2018, employees were exposed to eye injury while operating nail guns without the benefit of eye protection.     A J Carpentry, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102 (a)(1) which was contained in OSHA inspection number 974924, citation 1, item 1, and was affirmed as a final order on May 15, 2014, with respect to a worksite located at 1333 Warrington, Deerfield, Illinois.                 In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):                   a) On or about January 31, 2018, employees were exposed to the hazard of falling approximately 20 feet to the exterior of the building while working from the top plate and deck of the second story without the benefit of fall protection.       b) On or about January 31, 2018, employees were exposed to the hazard of falling approximately 9 feet from a second story to a lower deck while working without the benefit of fall protection.      A J Carpentry, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(13) which was contained in OSHA inspection number 974924, citation 1, item 2, and was affirmed as a final order on May 15, 2014, with respect to a worksite located at 1333 Warrington, Deerfield, Illinois.
