29 CFR 1910.147(c)(4): Energy control procedure.  29 CFR 1910.147(c)(4)(ii): The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following:  29 CFR 1910.147(c)(4)(ii)(B): Specific procedural steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy;  On or about March 19, 2017, the employer failed to develop and document clear, machine and/or equipment specific procedures for the control of hazardous energy during covered activities. Employees and/or contractors were required to  perform service and maintenance activities on equipment that included but was not limited to, powered industrial vehicles, woodworking equipment, "boiler plant" equipment and truck mounted lattice boom cranes.

29 CFR 1910.147(c)(7): Training and communication.  29 CFR 1910.147(c)(7)(i): The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following:  29 CFR 1910.147(c)(7)(i)(A): Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.  On or about March 19. 2018, the employer failed to provide and conduct training of authorized employees in lockout/tagout (hazardous energy control) procedure specific functions to be performed and purpose of the program, to include the knowledge and skills related to machine/equipment energy isolation and control, type of energy, magnitude of energy and recognition of hazardous energy sources for the machinery/equipment in the workplace.  The employer required service and maintenance activities, such as, but not limited to, the replacement of saw blades on woodworking equipment, mechanical repair of structural components on cranes and servicing of lattice boom crane hydraulic components.

29 CFR 1910.147(f):Additional requirements.   29 CFR 1910.147(f)(3): Group lockout or tagout.  29 CFR 1910.147(f)(3)(ii): Group lockout or tagout devices shall be used in accordance with the procedures required by paragraph (c)(4) of this section including, but not necessarily limited to, the following specific requirements:  29 CFR 1910.147(f)(3)(ii)(D): Each authorized employee shall affix a personal lockout or tagout device to the group lockout device, group lockbox, or comparable mechanism when he or she begins work, and shall remove those devices when he or she stops working on the machine or equipment being serviced or maintained.  On or about March 15, 2018, two employees performing required duties of service repair work on a truck mounted lattice boom crane hydraulic unit did not apply individual lockout/tagout devices to a group lockout device, group lockbox or other compliant comparable mechanism prior to work beginning. One employee performing the work put the "truck" key in his pocket without any group lockout device for the second employee to apply an individual control device upon. A third employee, who did not perform work, "locked" the operator cab without either employee applying an individual lockout/tagout device upon a group lockout device for the operator cab.

29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    29 CFR 1910.178(l)(1): Safe operation.    29 CFR 1910.178(l): Operator training.    On or about March 19, 2018, an employee operating a Ingersoll Rand rough terrain forklift had not received training and evaluation of safe operator training to determine competency in the safe operation of the equipment.

29 CFR 1910.132(d):  Hazard assessment and equipment selection.   29 CFR 1910.132(d)(2):  The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  On or about February 1, 2018, the employer had not completed the required workplace hazard assessment with the written and identified certification of the assessment.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.  On or about March 19, 2018, the employer utilized a forklift attachment for the Ingersoll Rand rough terrain forklift without manufacturer's written approval and without updating the manufacturer's data plate, to include the instructions. The custom made forklift attachment is used for casting bed "set up" activities on a routine basis.
