29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    (a) Scenic Shop - On or about January 24, 2018, employees are required to use respirators while performing welding activities and/or for saw collection from equipment that does not have a vacuum system and the employer did not provide them with a medical evaluation.    (b) - Stages throughout Theater - On or about January 24, 2018, employees are required to wear respirators when performing painting activities during scene construction and the employer did not provide them with a medical evaluation.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested whenever a different respirator facepiece (size, style, model or make) was used:  (a) Scenic Shop - On or about January 24, 2018, employees are required to use respirators while performing welding activities and/or for saw collection from equipment that does not have a vacuum system and the employer did not provide them with a fit test.   (b) - Stages throughout Theater - On or about January 24, 2018, employees are required to wear respirators when performing painting and gluing activities during scene construction and the employer did not provide them with a fit test.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).
