29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation. On or about February 1, 2018 and times prior thereto, at the worksite located at or near 5405 Hwy 5 N in Benton, AR, adequate precautions were not taken to protect employees from water accumulation in the trench. An employee was observed working in a trench with standing water up to his calves. This condition exposes employees to struck-by and engulfment hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about February 1, 2018 and times prior thereto, at the worksite located at or near 5405 Hwy 5 N in Benton, AR, an employee was observed working in a trench without protection from shifting soil. The soil was saturated due to recent rainfall and the trench had accumulated water in the bottom. This condition exposes employees to struck-by and engulfment hazards.
