29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a. On or about February 1st, 2018, in the spray painting downdraft booth, the employer failed to ensure that any employee conducting spray painting operations was wearing appropriate eye protection. The painter was observed wearing safety glasses, instead of goggles, which did not provide adequate protection from spray painting vapors and particles.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a. On or about February 1st, 2018, in the spray painting downdraft booth, the employer failed to develop and implement those elements of a written program necessary to ensure that any employee required to use a respirator during spray painting operations was medically able to use that respirator and knew how to properly select, use, clean, maintain and store the respirator.
