29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  (a) New residential construction, second level top plate: On or about 02/02/2018, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns at 120 PSI, in that protective eyewear was not provided to employees engaged in framing activities.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) New residential construction located on Lot #35, Second level top plate: On or about 02/02/2018, and at times prior, the employer exposed employees to falls hazards of 23-feet, 1-inch to the lower level, in that no fall protection system was provided to employees engaged in framing activities from the top outer plates.

29 CFR 1926.1053(a)(2): Ladder rungs, cleats, and/or steps were not parallel, level, and uniformly spaced when the ladder was in position for use:  (a) New residential construction located on Lot #35, First floor: On or about 02/02/2018, and at times prior, the employer exposed employees to fall hazards of 11-feet, 6-inches to the lower level, in that a job made ladder provided did not have uniform rungs/cleats as the space between the rugs were spaced between 16-inches and up to 26-inches apart. the employer failed to provide safe access to the upper level.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:  (a) New residential construction located on Lot #35, First floor: On or about 02/02/2018, and at times prior, the employer exposed employees to fall hazards of 3-feet, 8-inches to the lower level, in that employees used the top step of the stepladder to access a job-made ladder to access the second level. The employer failed to provide safe access to the upper levels of the structure.
