29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: Employees were using half and full-face respirators as protection against exposure to respirable crystalline silica dust, but they had not had medical evaluations prior to being issued these respirators. Furthermore, the respirators had not been cleaned and were hanging from their straps, not stored in a manner to protect them from exposure to contaminants, as required.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbars cannot be used. Location: Garage entrance and exit Employees were exposed to fall hazards while accessing a scaffold platform 10 feet 3 inches above the sidewalk, where proper access was not provided

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. Location: Garage Employees were using Hilti TE 30-C rotary hammer drills to chip damaged concrete ceilings and walls, and the drills did not have the appropriate engineering controls as specified in Table 1, which requires the use of a drill equipped with a shroud or cowling with dust collection equipment when using a rotary hammer drill.

29 CFR 1926.1153(i)(2)(i): The employer did not ensure that each employee covered by this section could demonstrate knowledge and understanding of the following items associated with exposure to respirable crystalline silica: Employees were drilling and grinding concrete walls and ceilings in garage, exposing themselves to respirable crystaliine silica. There was also between 50 and 75% crystalline silica in the patching compound, which was purchased in powder form. The employees weren't trained on the following items: 1) health hazards of exposure to respirable crystalline silica, 2) specific tasks that could result in exposure, 3) specific measures the employer has implemented to protect employees from exposure, 4) contents of the regulation, 5) identity of competent person, 6) purpose and description of medical surveillance program, 7) and the employer shall provide full copy of the regulation at no cost to employees
