29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:  (a) Throughout the facility, on or about February 1, 2018 and at times prior to, the employer implemented elements of a hearing conservation program based on information indicating that employees were exposed to noise levels equal to or in excess of an 8-hour time-weighted average of 85 decibels without developing or implementing a noise monitoring program, resulting in a noise hazard.

The employer did not institute a training program and ensure employee participation in the program:  (a) Throughout the facility, on or about February 1, 2018 and at times prior to, the employer did not provide training with regards to hearing conservation for employees who were exposed to noise levels equal to or in excess of an 8-hour time-weighted average of 85 decibels, resulting in a noise hazard.
