OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of vehicular collision resulting in ejection from the vehicle: On or about February 6, 2018, and in times prior thereto, on the John Deere Gator Utility Vehicle: a. Employees were not restrained in the seats to prevent ejection. b. The employer did not ensure the operator had adequate visibility by maintaining a clean windshield and prohibiting the use of plastic wrap on the front of the vehicle which obstructed the view.
