OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about February 2, 2018, at the East tower of the Seminole Gaming Hollywood Expansion hotel under construction on the 16th and 17th floor, employees were in the process of raising stand pipes without ensuring a locking and/or tagging device had been installed on the hose valve on the first floor, exposing employees to struck-by hazards.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about February 2, 2018, at the East tower of the Seminole Gaming Hollywood Expansion hotel under construction on the 16th and 17th floor, employees were working with a stand pipe that was air-pressurized without receiving training to recognize and avoid hazards associated with the lack of locking and/or tagging devices, exposing employees to struck-by hazards.
