29 CFR 1926.502(k)(1): A fall protection plan was not prepared by a qualified person and developed specifically for the site where the leading edge work, precast work, or residential construction work was being performed: At the apartment complex construction site, Old Sprigg Rd. & Bertling, Cape Girardeau, MO, during leading edge work (installation of first floor sheathing), where a fall hazard existed and the employer claimed it was infeasible to use guardrails or a personal fall arrest system, a fall protection plan was not developed and implemented. (The standard 1926.502 (k)(3) requires a copy of the plan to be on site which addresses all elements of the plan from 1926.502(k)(1) through (9)). Abatement documentation is required for this violation.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: At the apartment complex construction site, Old Sprigg Rd. & Bertling, Cape Girardeau, MO, during leading edge work (installation of first floor sheathing), where a fall hazard existed and the employer claimed it was infeasible to use guardrails or a personal fall arrest system, training, according to the requirements of 1926.503(a)(2)(I) through (viii) was not provided. A fall protection plan had not been developed and implemented. (The standard 1926.503(b)(1) requires training documentation to be provided to OSHA.) Abatement documentation is required for this violation.
