29 CFR 1910.147(c)(4)(ii): The Lock out/Tag procedure did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance.         On or about February 8, 2018, and times prior thereto, the employer did not ensure that the energy control procedures clearly and specifically outline the techniques to be utilized for the control of hazardous energy, when performing the servicing and maintenance activities on Egan Extruder machine.

29 CFR 1910.147(d)(3): All energy isolating devices that were needed to control the energy to the equipment were not physically located and operated in such a manner as to isolate the machine or equipment from the energy source.       On or about February 8, 2018, and times prior thereto, the employer failed to ensure that the isolating devices needed to control the hazardous energy for Egan extruder machine were applied to isolate the equipment from the hydraulic energy, water and air.

29 CFR 1910.212(a)(3)(ii): Point of operation of machinery was not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle.                                                                                                                In The Alternative       29 CFR 1910.28(b)(6)(i): Each employee less than 4 feet (1.2 m) above dangerous equipment was not protected from falling into or onto the dangerous equipment by a guardrail system or a travel restraint system, unless the equipment was covered or guarded to eliminate the hazard.       On or about February 8, 2018, and times prior thereto, the employer failed to provide machine guards and/or guardrail system to prevent employees that were feeding plastic film into the EGAN extruder from having any part of their body in the danger zone where there were rotating parts and/or a moving screw.

29 CFR 1910.28(b)(1)(i):  The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by Guard rail systems, safety net systems or Personal fall arrest system.         On or about February 8, 2018, at the Akrotex, Inc, Orange Texas location, the employer did not protect employees from a 5 foot 4 inches fall hazard, while working from an elevated platform and feeding a plastic film into an EGAN extruder.

29 CFR 1910.1030(g)(2)(ii)(A): The employer did not train each employee at the time of the initial assignment to tasks where occupational exposure to the biohazards could take place.       On or about February 15, 2018, the employer did not provide blood borne pathogens training to employees, who were exposed to blood and other potentially infectious materials while disassembled the Egan extruder machine for biohazard cleaning.
