OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from a Fiat Allis FR 11 Wheel Loader with a Forklift Attachment. The employer did not ensure that workers were clear of the machine and its attachments and load while it was being operated, that the auto on the forks was being carried low for maximum visibility while traveling, that the loader was carrying the auto at the proper speed for the load and ground conditions and that a signal person was present to guide the operator while working around people as detailed in the manufacturer's safety rules. a) 144 Main Road, Montville, NJ, in the scrap yard: Employee in the yard was exposed to struck-by hazards while a wheel loader was transporting a vehicle across its fork lift attachment in the vicinity of the employee.
