Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed and crushed-by hazards while moving metal pipes: On or about February 9, 2018 and times prior thereto, on the pipe stacks, employees roll pipe in an attempt to control the pipes movement.

29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: guardrail systems, safety net systems, or personal fall protection system, such as a personal fall arrest, travel restraint, or positioning system: On or about February 9, 2018, in the pipe yard where employees were exposed to fall hazards while stacking pipes from a working surface more than 4 feet above a lower level without a fall protection system in place. Womble Company, Inc. was previously cited for a violation of an equivalent Occupational Safety and Health Standard 29 CFR 1910.23(c)(1), which was contained in OSHA inspection number 1012507, citation number 1 item number 1 and was affirmed as a final order on July 15, 2014, with respect to a workplace located at 13101 Industrial Road, Houston, TX 77015.
