29 CFR 1910.134(e)(1):  The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace:        a) On and before 2/9/2018, at jobsite, for the employee wearing a 3M half face respirator while performing work such as, but not limited to, demolition, using hand tools to take walls down, and cleanup activities in an area where lead was present in debris on the floor and in paint on the walls, doors, and columns.  The employees were not provided a medical evaluation prior to being required to wear the respirator.

29 CFR 1926.62(h)(2): Where  possible, clean-up of floors and other surfaces where lead accumulated was not accomplished by vacuuming or other methods that minimized the likelihood of lead becoming airborne:  (a) On and before 2/9/2018, at jobsite, employees were exposed to lead while performing work such as, but not limited to, demolition, using hand tools to take walls down, and cleanup activities in an area where lead was present in debris on the floor and in paint on the walls, doors, and columns.  The employer did not use vacuuming or other methods while the employees were dry sweeping and shoveling debris containing lead.
