29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Pallet Assembly station: On or about March 5, 2018 and at times prior to, the employer exposed employees to noise dose at levels of 102.8 % (equivalent to an 8 hour time weighted average TWA of 91.7 dBA) which is 2.06 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while working at pallet assembly station. Results were calculated for a 455 minute sampling period with the remainder of the 480 minute sampling period calculated as 0 db. The employer failed to implement a Hearing Conservation Program. b) Pallet Assembly station: On or about March 5, 2018 and at times prior to, the employer exposed employees to noise dose at levels of 87.7 % (equivalent to an 8 hour time weighted average TWA of 90.6 dBA) which is 1.754 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while working at pallet assembly station. Results were calculated for a 385 minute sampling period with the remainder of the 480 minute sampling period calculated as 0 db. The employer failed to implement a Hearing Conservation Program. c) Chop saw station: On or about March 5, 2018 and at times prior to, the employer exposed employees to noise dose at levels of 64.7 % (equivalent to an 8 hour time weighted average TWA of 88.3 dBA) which is 1.29 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while working at chop saw station. Results were calculated for a 389 minute sampling period with the remainder of the 480 minute sampling period calculated as 0 db. The employer failed to implement a Hearing Conservation Program.
