29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:   a)  Nex Gen Baler Machine operator and loader:   On or about February 21, 2018 and at times prior too,  the employer exposed an employee to noise dose at levels of 69.5 % (equivalent to an 8 hour time weighted average TWA of 87.3 dBA) which is 1.39 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while working operating baler, forklift and bobcat. Results were calculated for a 4780 minute sampling period with a zero concentration assumption for the remaining 2 minutes.  The employer did not administer a continuing, effective hearing conservation program.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:   a)    Main shop recycling area:  On or about February 22, 2018 and at times prior, the employer exposed employees to loss of vision, skin burns and rashes, in that an emergency eyewash station was not located in the work area for immediate emergency use while employees while performing  daily job task of handling car batteries that contain acid.
