29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about February 20, 2018, the employer did not ensure that exposed shafts and shaft ends on buffing and polishing wheels were properly guarded in order to protect employees from caught-by hazards. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: On or about 2/20/2018, the employer did not evaluate the respiratory hazards in order to make a reasonable estimate of employee exposures to dust in the workplace. Employees used Divine Brothers Company brand 100% cotton cloth buffing/polishing wheels on metal parts. The employer failed to evaluate the levels of employee exposure to cotton dust in the workplace. No abatement is required for this item.
