29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    On or about 2/22/2018, the employer did not develop or maintain a written respiratory protection program for employee who were required to wear negative pressure half-face cartridge respirators while performing work in the paint booth. 29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  On or about 2/22/2018, the employer did not ensure that all employees required to wear 3M half-face respirators while performing painting work in the paint booth received a medical evaluation to determine the employee's ability to wear a respirator.   Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):  On or about 2/22/2018, the employer did not ensure that employees required to wear 3M half-face tight-fitting respirators had received a fit test in order to ensure that the respirator was appropriate for use by the employee.   Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:    On or about 2/22/2018, the employer did not ensure that employees wearing half-face air purifying respirators were free of facial hair in order to ensure that a seal was created between the face and the surface of the respirator facepiece.    Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

Employees working in the paint booth worked with hazardous chemicals, including but not limited to, VAP-9XX Tintable Vinyl Acrylic Primer containing n-butyl acetate and xylene.
