29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: (a) Action Plumbing and Heating Inc. located at 120 East 12th Street, Loveland, CO 80537: On and before February 22, 2018, the employer did not ensure that employees were protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects such as but not limited to falling dirt and materials from a spoils pile and excavator bucket. Employees were working in an 8' deep trench with the spoil pile near the edge, and while the excavator was operating, without the use of head protection. This condition exposed employees to the hazard of being struck on the head by falling soil, and by the excavator.

Employees were provided with material safety data sheets, but not updated safety data sheets, for hazardous chemicals, including but not limited to Oatey All Weather clear cement, Hercules Purple Primer and Hercules Cutting Oil. This condition exposed employees an increased risk of exposure to chemical hazards caused by the lack of information about the chemicals.
