29 CFR 1910.28(b)(1)(i): (1) Unprotected sides and edges. (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: guard rail system, safety net, or personal fall arrest system. a) On or about February 22, 2018, the 3rd floor mixing station work platform, had portions of the platform that did not have a guardrail or some other form of fall protection in place thereby exposing employees to a five foot fall with a concrete floor below. b) On or about February 22, 2018, the roof top did not have a guardrail or some other form of fall protection in place thereby exposing employees to a 30 foot fall with a paved drive below.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about February 22, 2018, employees were operating the BOSCH bagger/sealer machine, located on the third floor, with the guard bypassed; thereby exposing the employees to ingoing nip points/pinch points.
