29 CFR 1915.74(a)(1): The employer permitted employees to board or leave a vessel by using a substantial straight ladder that was not adequately secured against shifting or slipping when a gangway was not practicable. On or about 02-15-2018 and times prior thereto, located onboard the U.S.S. Nitze - DDG-94, afloat in the Elizabeth River, at or near Craney Island, Portsmouth, VA 23703, Condition: The employer, while under a "dead stick" transfer via tug power from MHI Pier in Portsmouth, VA enroute to Pier 7 Norfolk Naval Base, required two civilian employees to disembark the naval vessel (port side mid-ship) on to a tug by climbing onto and down a straight aluminum ladder that was not adequately secured at the top (on the naval vessel) nor at the bottom of the ladder (on the tug boat). Two Navy ships crew members were physically holding the top of the ladder while a tug crewman was footing the bottom of the ladder during the vessel to vessel transfer. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employee(s) and their representatives were informed of this abatement.

29 CFR 1915.152(a): The employer did not provide or ensure each affected employee with the appropriate personal protective equipment (PPE) for the eyes, face, head, extremities, torso, and respiratory system, including protective clothing, protective barriers, personal fall protection equipment, and life saving equipment, meeting the applicable provisions of Subpart I, wherever employees were exposed to work activity hazards that required the use of PPE. On or about 02-15-2018 and times prior thereto, located onboard the U.S.S. Nitze - DDG-94, afloat in the Elizabeth River, at or near Craney Island, Portsmouth, VA 23703, Condition: The employer, while under a "dead stick" transfer via tug power from MHI Pier in Portsmouth, VA enroute to Pier 7 Norfolk Naval Base, required two employees to disembark the naval vessel (port side mid-ship) and transfer themselves to a tug by climbing onto and down a straight aluminum ladder and did not provide nor require the use of personal flotation devices (PFD'S). Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employee(s) and their representatives were informed of this abatement.
