29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) Hohm Construction, at 2297 Kansas Avenue SE, Huron, SD 57350: On or about and at times prior to February 22, 2018, the employer did not ensure that each employee was protected from falls from heights in that three employees were installing second level floor sheathing on a commercial property with no fall protection in place. This condition exposed the employees to a fall hazard of approximately 14 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) Hohm Construction, at 2297 Kansas Avenue SE, Huron, SD 57350: On or about and at times prior to February 22, 2018, the employer did not ensure that each employee engaged in sheathing operations on a commercial property, had been trained to recognize the hazards associated with working at elevations over 6 feet. Employees working on site had not received fall protection training before working at elevations over 6 feet. The condition exposed employees to the hazard of falling from an elevation of approximately 14 feet 5 inches. Abatement Note: The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.

Employees were using a ladder to access second level to install floor sheathing. This condition exposed employees to a fall hazard of 14 feet 5 inches.
