29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. On February 26, 2018, located on the north side of a residential exterior structure, an employee was observed installing metal trim onto the exterior structure standing at the edge of a low pitch roof while not utilizing an adequate fall protection system. Potential Fall Heights were measured to be 11'-4" with a roof pitch of 4/12.

29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection. On February 26, 2018, located on the north side of a residential exterior structure, an employee was exposed to a fall hazard installing metal trim to the exterior structure while standing on a low pitch roof as the employer failed to install a fall protection system before the employee started work. Potential fall height was measured to be 11'-4 feet with a roof pitch of 4/12. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
