29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a. From September 2017 until February 27, 2018, at a worksite located at 3820 Cleveland Avenue, Columbus, Ohio, employees were conducting work from a fabricated elevated scaffold platform 32 feet wide, supported by a rough terrain forklift that was eight feet, three inches wide. The platform extended 11 feet, 10.5 inches past the outside of each tire, exposing the employees to a ten foot fall hazard. b. From September 2017 until February 27, 2018, at 3820 Cleveland Avenue, Columbus, Ohio, a forklift was modified to support personnel by the addition of a platform, without the capacity, operation, and maintenance instruction plates, tags, or decals changed accordingly, thereby exposing employees to a ten foot fall hazard.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a. On or before February 27, 2018, where employees were installing trim to the cupola, the employees were not protected from falls, thereby being exposed to a 10-foot fall hazard.
