29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) Worksite, south side of Building #3: Two employees were working at a height of approximately 30 feet on a fabricated frame scaffold with middrail removed and top rail displaced; on or about 2/27/18. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below: a) Worksite, south side of Building #3: A fabricated frame scaffold with employees working on a platform approximately 30 feet in height was erected without toeboards to protect employees below from falling objects such as, but not limited to bricks and handtools; on or about 2/27/18 Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
