29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On or about February 28, 2018, during the separation of a residential sewer line at 161 Parkwood Avenue, Avon Lake, Ohio, the employer did not ensure an employee working inside an approximately 8 foot deep trench was protected from cave-ins by an adequately designed protection system. The soil was classified as Type B . HECZKO LANDSCAPING & EXCAVATING, LLC, WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.652(c), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1229928, CITATION NUMBER 01, ITEM NUMBER 002 AND WAS AFFIRMED AS A FINAL ORDER ON OR ABOUT JUNE 14, 2017, WITH RESPECT TO A WORK PLACE LOCATED AT 191 JAYCOX ROAD, AVON LAKE, OHIO.
