29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical agents: (a) Worksite: 8 Woodland Way, Quogue, NY, residential roof- An employee was using a RIDGID 18-Volt Cordless 15-gage angled nailer Model Number R250AF18 to install vinyl siding without using eye protection, on or about 2/27/2018. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

The employees were not protected from falling, on or about 02/27/18. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Where (a) portable ladder was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. (a) Worksite: 8 Woodland Way Quogue, NY, south side of residential home - Employees were using and extension ladder to access the roof at approximately 13ft. above the ground below. The ladder side rails were extended approximately 6in above the landing surface, on or about 2/27/2018. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
