(a)Bahena Construction, LLC at 1121 Covell Avenue, Sioux Falls, SD 57104: On and prior to February 27, 2018, the employer did not ensure each employee on a walking/working surface having an unprotected side or edge which was six feet or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system in that, an employee engaged in sheathing operations on the roof of a commercial building under construction was not protected from fall hazards. An employee was disconnecting from anchorages located at the top of the roof and walking near the edge of the roof while exposed to falls. This condition exposed employees to fall hazards in excess of 6 feet.

29 CFR 1926.502(d)(17): The attachment point of the body belt shall be located in the center of the wearer's back. The attachment point of the body harness shall be located in the center of the wearer's back near shoulder level, or above the wearer's head.  (a)Bahena Construction, LLC at 1121 Covell Avenue, Sioux Falls, SD 57104: On and prior to February 27, 2018, the employer did not ensure the back D-ring or attachment point of the body harness was on the wearer's back near shoulder level. The employee wearing the full body harness with the back D-ring below the shoulder level caused the employee to be exposed a free fall distance greater than six feet and an increase in the maximum arresting force in excess of 1,800 lbs. This condition exposed an employee to injuries resulting from increased arresting forces during a free fall.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   (a)Bahena Construction, LLC at 1121 Covell Avenue, Sioux Falls, SD 57104: On and prior to February 27, 2018, the exposing employer did not ensure each employee engaged in roof sheathing operations were trained to recognize the hazards of working at elevation and trained in the use of fall protection systems. Employees disengaged their fall protection equipment from anchors located at the top of the structure under construction and walked along the top of the roof without being protected from falls. This condition exposed employees to fall hazards in excess of 6 feet.  Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:     a)The nature of fall hazards in the work area;  b)The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;  c)The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  d)The role of each employee in the safety monitoring system when this system is used;  e)The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs;  f)The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and  g)The role of employees in fall protection plans;  h)The standards contained in this subpart.
