29 CFR 1926.652(c)(2)(i): 29 CFR 1926.652(c)(2)(i): Design of support systems, shield systems, or other protective systems that are drawn from manufacturer's tabulated data were not in accordance with all specifications, recommendations, and limitations issued or made by the manufacturer:    (a) On or about February 28, 2018, and at times prior, the employer did not ensure that protective systems used onsite were in accordance to manufacturers specifications, recommendations, and limitations, in that shield systems were installed without a bottom 24 inch spreader, and during a trench collapse the shield system's wall closest to the collapse site shifted inward while an employee conducted residential sewer line repair operations. 29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:    (a) On or about February 28, 2018, and at times prior, the employer did not protect employees from fall hazards or other serious injury due to a defective ladder not being withdrawn from service. Structural components of the ladder such as rungs, cleats, and rails were observed to be contorted. The defective ladder was being used to access an area of a trench to be approximately 11 feet. 29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):    (a) On or about February 28, 2018 and at times prior, the employer did not ensure that employees conducting work in a trench were fully protected from cave-in hazards, in that work performed to install a new residential sewer line was done in an area of the trench that was adjacent to an unprotected vertical wall on the northern-most end of the trench, approximately 15 deep. During a collapse of the trench on February 27, 2018, part of the aforementioned wall partially engulfed an employee up to his chest who was tasked with discovering the main tap.     Master Excavating LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652 Requirements for protective systems, which was contained in OSHA inspection number 948093, citation number 1, item number 2 and was affirmed as a final order on December 31, 2013, with respect to a workplace located at 2732 W. 106th Circle, Westminster, CO 80234.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  (a) On or about February 28, 2018, and at times prior, the employer did not ensure that an effective inspection of the excavation, the adjacent areas, and the protective systems was conducted by a competent person as needed throughout the shift, in that a collapse occurred partially burying an employee, and protective systems were not adequate.  Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").  Master Excavating LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651 Specific excavation requirements, which was contained in OSHA inspection number 948093, citation number 1, item number 1/a and was affirmed as a final order on December 31, 2013, with respect to a workplace located at 2732 W. 106th Circle, Westminster, CO 80234.
