29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval. On or about 5 March 2018, and at times prior thereto, a job-made wooden trash box was used at the work site for construction trash and debris, or for moving materials, without the approval of the manufacturer, exposing the operator and those nearby to the hazard of being struck by the trash box and the contents.
