OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and crushing hazards form the collapse of a wooden framed balloon wall: a) 3 Bigelow Dr., Berlin, MA: on or about February 26, 2018, several employees were exposed to struck by and crushing hazards while attempting to lift and secure a 20.2 foot high by 36 foot wide 2x6 (framed) fully sheathed wooden stud balloon wall by hand. During the lifting process, the group could not manage the weight of the wall, and it collapsed on the group striking several employees, and pinning one under the wall causing serious injuries to the pinned employee. Among other methods, one feasible and acceptable method to correct this hazard is to comply with Safety and Health Bulletin SHIB 11-17-2005 specifically, paragraph 5, 'Safe Lifting Methods' which discusses the need for pre lift meetings, the establishment of a limited access zone, the use of mechanical or powered wall jacks to assist with the lift and ensuring that employees are trained before engaging in this type of work.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system: a) 3 Bigelow Dr., Berlin, MA: On or about February 26, 2018, several employees were exposed to various falls (hole and edge of work area) during this residential construction project ranging from 14 to 18 feet to the lower level. Superior Construction LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(B) (13), which was contained in OSHA inspection number 1286921, citation number 1, item number 1b and was affirmed as a final order on February 1, 2018, with respect to a workplace located at 130 Lexington St., Woburn, MA. Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29CFR1903.19(d)(1).
