29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On March 8, 2018, located on the southeast side of a commercial structure, there were no frequent and regular inspections being performed by a competent person to ensure the jobsite, materials and equipment such as scaffolds (aerial lifts) & fall protection systems and/or devices were being maintained and utilized in a safe condition.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On March 8, 2018, located on the southeast side of a commercial structure, employees were observed working from a JLG 450AJ articulating boom lift without being attached to the boom or basket. Potential fall heights were measured to be greater than 10 feet above the concrete surface below.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: On March 8, 2018, employees were observed working from a JLG 450AJ articulating boom lift, without being attached to the boom or basket, that were not provided training to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. Potential fall height was measured to be greater than 10 feet above the concrete surface below while not utilizing a fall protection system.

29 CFR 1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training. The employer did not have written certification of fall protection training for employees observed performing window replacement from an aerial lift while not utilizing a fall protection system and exposed to potential fall heights in excess of 10 feet.
