29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):    a. Painting Area: On or about March 5, 2018, and at times prior, employees were exposed to hazards from chemicals including, but not limited to, 2-butoxyethanol, while performing spray operations without having performed a hazard assessment.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:     a) Main Shop: On or about March 5, 2018, and at times prior, employees were exposed to respiratory hazards from chemicals including, but not limited to, copper, manganese, iron oxide fume (mild steel), and 2-butoxyethanol (KEM AQUA 70P Primer) while using these chemicals in various phases of the metal fabrication process. The employer did not provide medical evaluations to employees required to use the respirators as required in 1910.134(c)(1)(ii).        b) Main Shop: On or about March 5, 2018, and at times prior, employees were exposed to respiratory hazards from chemicals including, but not limited to, copper, manganese, iron oxide fume (mild steel), and 2-butoxyethanol (KEM AQUA 70P Primer) while using these chemicals in various phases of the metal fabrication process. The employer did not provide fit testing procedures for tight-fitting respirators to employees required to use the respirators as required in 1910.134(c)(1)(iii).        c) Main Shop: On or about March 5, 2018, and at times prior, employees were exposed to respiratory hazards from chemicals including, but not limited to, copper, manganese, iron oxide fume (mild steel), and 2-butoxyethanol (KEM AQUA 70P Primer) while using these chemicals in various phases of the metal fabrication process. The employer did not provide procedures for proper use of respirators in routine and reasonably foreseeable emergency situations for tight-fitting respirators to employees required to use the respirators as required in 1910.134(c)(1)(iv).        d) Main Shop: On or about March 5, 2018, and at times prior, employees were exposed to respiratory hazards from chemicals including, but not limited to, copper, manganese, iron oxide fume (mild steel), and 2-butoxyethanol (KEM AQUA 70P Primer) while using these chemicals in various phases of the metal fabrication process. The employer did not provide training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations for employees required to use the respirators as required in 1910.134(c)(1)(vii).        e) Main Shop: On or about March 5, 2018, and at times prior, employees were exposed to respiratory hazards from chemicals including, but not limited to, copper, manganese, iron oxide fume (mild steel), and 2-butoxyethanol (KEM AQUA 70P Primer) while using these chemicals in various phases of the metal fabrication process. The employer did not provide training on putting on, removing, or the limitations of the respirators for employees required to use the respirators as required in 1910.134(c)(1)(viii).

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a. Main Shop: On or about March 5, 2018, and at times prior, employees were exposed to chemical hazards from using unlabeled and defaced labeled containers of chemicals including, but not limited to, xylene, while performing cleaning operations involving spray guns throughout the facility.     b. Main Shop: On or about March 5, 2018, and at times prior, employees were exposed to chemical hazards from using chemicals including, but not limited to, xylene, copper, manganese, and 2-butoxyethanol, while performing welding and painting operations throughout the facility without the employer maintaining Safety Data Sheets (SDSs) for the above listed chemicals.     c. Main Shop: On or about March 5, 2018, and at times prior, employees were exposed to chemical hazards from using chemicals including, but not limited to, xylene, copper, manganese, and 2-butoxyethanol, while performing welding and painting operations throughout the facility without having had sufficient training and information with regard to hazards associated with the chemicals.
