29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following:  Guardrail systems, safety net systems, or personal fall arrest systems:  a. On or about 03/07/2018, at the shop - employees conducting maintenance, repairs or installation of cooling units from the top of the truck cabins were exposed to about a 9 feet 4 inch fall hazard, in that, fall protection was not used.

29 CFR 1910.30(a)(1): Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart. Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017.   a. On or about 03/07/2018, at the shop - employees conducting maintenance, repairs or installation of cooling units from the top of the truck cabins and were exposed to about a 9 feet 4 inch fall hazard, were not provided fall protection training.

On or about 03/07/2018, at the job site - employees were exposed to forklift related hazards, in that, forklift operators were not evaluated to operate the counter balance sit-down forklifts at least once every three years.    THERMO KING OF THE SOUTHEAST, LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 19100178(L)(4)(III), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1037811, CITATION NUMBER 01, ITEM NUMBER 001 AND WAS AFFIRMED AS A FINAL ORDER ON 03/17/2015, WITH RESPECT TO A WORKPLACE LOCATED AT 4949 N. ORANGE BLOSSOM TRAIL, ORLANDO, FL 32810.
