29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  (a) Production Area, Small bottle line-  On or about March 14, 2018, and at times prior, the employer exposed employees to noise hazards, in that the employer failed to implement a hearing conservation program for employees exposed to noise levels above the Action Level of 85 dBA while operating the filler machine and working near the air knives in the labeling area.   An employee operating the filler machine on the small bottle line was exposed to continuous noise at 97.23 % of the permissible daily exposure of 85 dBA (time weighted average) or an equivalent sound level of 89.8 dBA during the 438 minute sampling period on March 14, 2018. The exposure calculation included a zero increment for the 42 minutes not sampled.   An employee working on the small bottle line near the air knives in the labeling area was exposed to continuous noise at 115.0 % of the permissible daily exposure of 85 dBA (time weighted average) or an equivalent sound level of 91.0 dBA during the 435 minute sampling period on March 14, 2018. The exposure calculation included a zero increment for the 45 minutes not sampled.
