29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95 (c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    Essex Electro Engineers, Inc., Schaumburg, IL - On March 22, 2018, the employer did not administer a continuing, effective hearing conservation program when employee noise exposure equaled or exceeded an 8-hour time-weighted average (TWA) sound level of 85 decibels measured on the A-scale, or equivalently a dose of fifty percent:    a) On March 22, 2018, an employee working at Essex Electro Engineers, Inc., Schaumburg, IL testing ground power units in the test area was exposed to continuous noise levels at 88.4% of the allowable 8-hour time-weighted average (TWA) sound level (90 dBA). The equivalent dBA level of 88.4% is approximately 89.1 dBA, which exceeds the action level of 85 dBA. The sampling was performed for 448 minutes during one 8-hour work shift on March 22, 2018. Zero exposure was assumed for the unsampled period of time, 32 minutes.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1200(f)(6)(i): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information required by 29 CFR 1910.1200(f)(1)(i) through 29 CFR 1910.1200(f)(1)(v)    a) On March 7, 2018, a 55 gallon drum of JP8 (jet fuel) was not labeled with the signal word, hazard statement, pictorgram, and precautionary statement associated with the hazardous chemical contained in the drum. This drum was located at the entrance of suite A from suite B.    b) On March 7, 2018, a 55 gallon drum of waste oil was not labeled with the signal word, hazard statement, pictorgram, and precautionary statement associated with the hazardous chemical contained in the drum. This drum was located at the entrance of suite A from suite B.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.37(e): The employer did not assure that fire alarm signaling systems were maintained and tested in accordance with the requirements of 29 CFR 1910.165(d):  a) On March 7, 2018, Essex Electro Engineers, Inc. did not assure that the fire alarm in suite A was operable.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
