29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  On or about March 6, 2018, the employer did not develop and implement a written hazard communication program for employees utilizing hand-held portable circular saws to cut cement fiber board (Hardie-Plank) containing crystalline silica, exposing the employees to an inhalation hazard.  Required program elements that were not developed and implemented include the following:  1910.1200(f): Labels and other forms of warning. 1910.1200(g): Safety data sheets. 1910.1200(h): Employee information and training.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about March 6, 2018, employees were utilizing hand-held circular saws to cut materials without the use of eye protection, exposing the employees to the hazard of being struck by flying objects.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about March 6, 2018, an employee was installng trim around a second-floor balcony door of building #2 at the residential apartment complex under construction. The employee was working approximately 10 feet high without fall protection, exposing the employee to a fall hazard.  The Rigoberto Delgado was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1037349, citation number 1 item number 3 and was affirmed as a final order on June 24, 2015, with respect to a workplace located at 24949 Katy Ranch, Katy, TX 77494.
