29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  On or about March 12, 2018, at the construction site located at 5607-5617 Dasher Circle in Columbus, Ohio, the employer failed to maintain a safety and health program to ensure hazard detection and correction.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a. On or about March 12, 2018, at the construction site located at 5607-5617 Dasher Circle in Columbus, Ohio, the employer failed to ensure employees were adequately trained to identify and correct hazards while performing framing work.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.   The employer does not protect each employee from the hazard of falling by the use of fall protection devices.     This most recently occurred on March 12, 2018, at the construction site located at 5607-5617 Dasher Circle in Columbus, Ohio. The employer failed to ensure employees performing framing work from the top of the second floor walls and open floor joists were protected by fall protection.    Hilario Javier Ponce/HJP Construction, LLC was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1026.501(b)(13) which contained OSHA inspection numbers:    1) 1233335, Citation 1-Item 1, Issued on 06/22/2017 2) 1203734, Citation 2-Item 1, Issued on 02/07/2017 3) 1188927, Citation 1-Item 1, Issued on 11/16/2016    Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards.

Hilario Javier Ponce was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1026.503(c)(3) which contained OSHA inspection number 1188927, citation number 1, item number 2, and was affirmed final order on 11/28/2016, with respect to the workplace located at 1121 Mirror Lake Place, Columbus, Ohio.
