29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about March 12, 2018, at the construction site located at 543-542 West Broad Street, Columbus, Ohio, the employer failed to maintain a safety and health program to ensure fall hazard detection and correction.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.   a. On or about March 12, 2018, at the construction site located at 543-542 West Broad Street, Columbus, Ohio, the employer did not ensure that two employees framing from the fifth floor of the building were utilizing fall protection. Employees were not attached to a lifeline, thereby exposing the employees to a fall hazard of approximately sixty foot.

29 CFR 1926.502(d)(21): Personal fall arrest systems shall be inspected prior to each use for wear, damage and other deterioration, and defective components shall be removed from service.   a. On or about March 12, 2018, at the construction site located at 543-542 West Broad Street, Columbus, Ohio, the employer did not ensure employees inspected personal fall protection harnesses prior to working from heights in order to identify tears and damage to the webbing. While working from heights of approximate sixty foot from the ground, an employees harness had an approximately half inch tear in the shoulder strap.

Note: The following appendices to subpart M of this part serve as non-mandatory guidelines to assist employers in complying with the appropriate requirements of subpart M of this part.   a. On or about March 12, 2018, at the construction site located at 543-542 West Broad Street, Columbus, Ohio, the employer did not ensure that employees framing on the fifth floor of the building retained the knowledge and skills to inspect and utilize personal fall arrest systems consisting of harnesses, retractable lifelines, and anchorage straps.
