29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:     Lamination Specialties Corporation, 2254 W. Fulton, Chicago, IL - On March 19, 2018, the employer did not institute an effective hearing conservation program when employee noise exposures were at or above the 8-hour time-weighted average sound level of 85 decibels.       a) A temporary employee working on Press Line #18 in the Production Department at Lamination Specialties Corporation, Chicago, IL, was exposed to continuous noise levels at 77% of the allowable OSHA 8-hour time-weighted average sound level (90 dBA). The equivalent dBA level of 77% is approximately 88.1 dBA, which exceeds the action level of 85 dBA. The sampling was performed for 393 minutes during an 8-hour shift on March 19, 2018. Zero exposure was assumed for the unsampled time period of 87 minutes.      b) A temporary employee, also working at Press Line #18 in Production Department at Lamination Specialties Corporation, Chicago, IL, was exposed to continuous noise levels at 66% of the allowable OSHA 8-hour time-weighted average sound level (90 dBA). The equivalent dBA level of 66 % is approximately 87.0dBA, which exceeds the action level of 85 dBA. The sampling was performed for 396 minutes during an 8-hour shift on March 19, 2018. Zero exposure was assumed for the unsampled time period of 84 minutes.      c) A temporary employee working on Press Line #4 in Production Department at Lamination Specialties Corporation, Chicago, IL, was exposed to continuous noise levels at 67% of the allowable OSHA 8-hour time-weighted average sound level (90 dBA). The equivalent dBA level of 67% is approximately 87.1 dBA, which exceeds the action level of 85 dBA. The sampling was performed for 398 minutes during an 8-hour shift on March 19, 2018. Zero exposure was assumed for the unsampled time period of 82 minutes.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1200(e)(1)(i): The employer did not compile and maintain a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet:  a) Lamination Specialties Corporation, Chicago IL- On March 14, 2018, the employer did not compile and maintain as part of their written Hazard Communication Program a list of the hazardous chemicals known to be present in the work place using a product identifier that is cross-referenced with the appropriate safety data sheet.  Lamination Specialties Corporation employees, including temporary workers, were exposed to hazardous chemicals including, but not limited to the following products from Rock Valley Oil & Chemical: RV EP lubricant S-220,Trojan 32AW, 46AW & 68AW industrial lubricant(s) and Rockform 5130L metalworking fluid containing petroleum distillates, mineral oils, heavy alkyl naphtha.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
