29 CFR 1910.134(g)(1)(i): The employer shall not permit respirators with tight-fitting facepieces to be worn by employees who have:   29 CFR 1910.134(g)(1)(i)(A): Facial hair that comes between the sealing surface of the facepiece and the face or that interferes with valve function; or   a. At the job site on or before March 14, 2018, where employees were removing black mastic containing greater than 1% asbestos, the employer did not ensure that an employee's facial hair did not come between the sealing surface of the North 7700-30M half facepiece respirator and the face.

29 CFR 1910.134(h)(3)(ii): The employer shall ensure that respirator inspections include the following:   29 CFR 1910.134(h)(3)(ii)(A): A check of respirator function, tightness of connections, and the condition of the various parts including, but not limited to, the facepiece, head straps, valves, connecting tube, and cartridges, canisters or filters.   a. At the job site on or about March 16, 2018, the employer did not ensure that respirator inspections were thoroughly being conducted, in that an employee's North 7700-30L half facepiece respirator was missing an inlet valve.

The recommendation shall provide only the following information:   29 CFR 1910.134(e)(6)(i)(A): Any limitations on respirator use related to the medical condition of the employee, or relating to the workplace conditions in which the respirator will be used, including whether or not the employee is medically able to use the respirator.   a. At the job site on or before March 16, 2018, where employees were removing black mastic containing greater than 1% asbestos, at least one employee's Physician's Written Opinion, dated January 19, 2018, did not include whether or not the employee was medically able to use a respirator.

29 CFR 1910.134(m)(2)(i): The employer shall establish a record of the qualitative and quantitative fit tests administered to an employee including:   29 CFR 1910.134(m)(2)(i)(C): Specific make, model, style, and size of respirator tested.   a. At the job site on or before March 16, 2018, where employees were removing black mastic containing greater than 1% asbestos, the employer did not ensure that an employee's Respirator Fit Test Record, dated April 18, 2017, identified the manufacturer, model, and size of the full face powered air-purifying respirator (PAPR) and the manufacturer and model of the half face respirator.   b. At the job site on or before March 16, 2018, where employees were removing black mastic containing greater than 1% asbestos, the employer did not ensure that an employee's Respirator Fit Test Record, dated July 31, 2017, identified the model of the full face PAPR and the model of the half face respirator.   c. At the job site on or before March 16, 2018, where employees were removing black mastic containing greater than 1% asbestos, the employer did not ensure that an employee's Respirator Fit Test Record, dated June 14, 2017, identified the model of the full face PAPR and the model and proper size (large versus medium) of the half face respirator.   d. At the job site on or before March 16, 2018, where employees were removing black mastic containing greater than 1% asbestos, the employer did not ensure that an employee's Respirator Fit Test Record, dated March 23, 2017, identified the manufacturer, model, and size of the full face PAPR and the model of the half face respirator.   e. At the job site on or before March 16, 2018, where employees were removing black mastic containing greater than 1% asbestos, the employer did not ensure that an employee's Respirator Fit Test Record, dated January 23, 2018, identified the model of the full face PAPR.   f. At the job site on or before March 16, 2018, where employees were removing black mastic containing greater than 1% asbestos, the employer did not ensure that an employee's Respirator Fit Test Record, dated June 14, 2017, identified the model of the full face PAPR and the model of the half face respirator.

29 CFR 1910.1200(g)(1): Chemical manufacturers and importers shall obtain or develop a safety data sheet for each hazardous chemical they produce or import. Employers shall have a safety data sheet in the workplace for each hazardous chemical which they use.   a. At the job site on or before March 16, 2018, where employees were removing black mastic containing greater than 1% asbestos, and employees were using mastic remover, the employer did not have or maintain a safety data sheet (SDS) for Sentinel PL-145 Low Odor Mastic Remover.   b. At the job site on or before March 16, 2018, where employees were removing black mastic containing greater than 1% asbestos, and employees were using adhesive spray, the employer did not have or maintain a safety data sheet (SDS) for Jendco Heavy Duty Adhesive Spray.
