29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about March 15, 2018, employees were working elevated surfaces of a commercial building without using any form of fall protection. Employees were exposed to fall hazards of more than six feet to the ground below.

29 CFR 1926.503(c)(3): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section. On or about March 15, 2018, employees were working elevated surfaces of a commercial building without having adequate understanding and skill in using fall protection equipment. This condition exposed employees to fall hazards greater than six feet.
