29 CFR 1910.1001(j)(3)(iii): The employer did not inform employees who performed housekeeping activities in area(s) which contained ACM and/or PACM of the presence and location of ACM and/or PACM in such area(s) which might have been contacted during such activities.  On or about March 15, 2018, in the Store (Sales Area), East Warehouse, and West Warehouse, employees were exposed to asbestos containing material (ACM) when broom sweeping the floors and the employer did not inform the employees of the presence and location of ACM and/or PACM.

29 CFR 1910.1001(j)(5)(i): The building owner(s) or employer(s) did not affix or post labels or signs on identified ACM and/or PACM that had been previously installed, so that employee(s) would be notified of what materials contained ACM and/or PACM.  Labels were not affixed to all raw materials, mixtures, scrap, waste, debris, and other products containing asbestos fibers, or to their containers.  The employer(s) did not attach such labels in area(s) where they would be clearly noticed by employee(s) who were likely to be exposed, such as at the entrance to mechanical room/areas.    Note: signs required by paragraph (j) of this section may be posted in lieu of labels so long as they contain the information required for labeling.   On or about March 15, 2018, in the Store (Sales Area), East Warehouse, and West Warehouse, employees were exposed to asbestos containing material (ACM) and the employer did not label the areas known to contain ACM and/or presumed-ACM (PACM).

29 CFR 1910.1001(j)(7)(iv): The employer did not provide to all employees who perform housekeeping operations in areas where ACM and/or PACM is present, an asbestos awareness training course which contained the following elements: the health effects of asbestos, locations of ACM and PACM in the building/facility, recognition of ACM and PACM damage and deterioration, requirements in this standard related to housekeeping, and/or proper response to fiber release episodes, at least once a year.  On or about March 15, 2018, in the Store (Sales Area), East Warehouse, and West Warehouse, employees were exposed to asbestos containing material (ACM) when broom sweeping the floors and the employer did not provide employees an awareness training course during the previous year that included the following:  a) health effects of asbestos; b) locations of ACM and PACM in the building; c) recognition of ACM and PACM damage and deterioration; d) requirements of the standard for housekeeping; and e) response procedures to fiber release episodes.

29 CFR 1910.1001(k)(8): The employer cleaned up waste and debris and accompanying dust in an area containing accessible or visibly deteriorated ACM and/or PACM, by dry dusting, dry sweeping or vacuuming without using high-efficiency particulate air filters:  On or about March 15, 2018, in the West Warehouse, employees were exposed to asbestos containing material (ACM) and the employer permitted employees to dry sweep damaged ACM and/or presumed-ACM debris into open-topped receptacles.
