OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a) Southwest corner of the commercial construction site, an employee was climbing on the guardrails of the a scissor lift to access the working level of the concrete formwork. An employee was exposed to a fall hazard of 11-feet to 49-feet depending upon the direction of the fall.

29 CFR 1926.501(b)(12): Each employee engaged in the erection of precast concrete members (including, but not limited to the erection of wall panels, columns, beams, and floor and roof "tees") and related operations such as grouting of precast concrete members, who is 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems. (a) Southwest corner of the commercial construction site, employees performing concrete beam casting operations were exposed to the hazard of falling 23-feet to the ground below.
