29 CFR 1926.62(k)(2)(i): The employer did not provide an employee up to eighteen (18) months of medical removal protection benefits on each occasion that an employee was removed from exposure to lead or otherwise limited pursuant to 29 CFR 1926.62: a) Rt. 22 Lehigh River Bridge: An employee was medically removed from cutting bridge beams due to medical order by a doctor and the employer did not maintain the employees' total normal earnings, on or about March 15, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1926.62(k)(2)(vi): The employer did not provide medical removal protection benefits to an employee equal to that required by 29 CFR 1926.62(k)(2)(i) and (ii) when the employer, although not required to do so by 29 CFR 1926.62, removed said employee due to the effects of lead exposure on the employee's medical condition: a) Rt. 22 Lehigh River Bridge: An employee was voluntarily removed from cutting bridge beams due to high blood lead levels and the employer did not maintain the employees' total normal earnings, on or about March 15, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1926.62(n)(3)(i): The employer did not establish and maintain an accurate record for each employee removed from exposure to lead pursuant to 1926.62(k): a) Route 22 Lehigh River Bridge: Two Carpenters with elevated blood lead levels were removed voluntarily from activities that exposed the employees to lead during the demolition of the bridge and the employer did not establish or maintain a medical removal record for each employee as required by the standard, on or about March 15, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
