29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  Construction Site: On or about March 15, 2018, an employee was observed operating a pneumatic nail gun without wearing safety glasses. This condition exposed employee to struck-by hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  Construction Site: On or about March 15, 2018, two employees were observed working on different level roofs without utilizing fall protection equipment they were wearing. This condition exposed employees to a fall hazard of more than 6-ft. to the ground below.  J. Hernandez Framing was previously cited for a violation of this occupational safety and health standard 29CFR 1926.501(b)(13), which was contained in OSHA inspection number 1262083, citation number 01, item number 001 and was affirmed as a final order on January 30, 2018, with respect to a workplace located at 2045 Roy Vinson, El Paso, TX 79938

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  Construction Site: On or about March 15, 2018; the employer did not ensure that the employees retained the requisite understanding to recognize the hazards of falling. This condition exposed employees to a fall hazard of more than 6-feet to the ground below.  J Hernandez Framing was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.503(C)(3), which was contained in OSHA inspection number 1262083, citation number 01, item number 002 and was affirmed as a final order on January 30, 2018, with respect to a workplace located at 2045 Roy Vinson, El Paso, TX 79938.
